Welcome to GeneralAccessCrossing ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at generalaccesscrossing.sbs (the "Service") operated by GeneralAccessCrossing.
By booking a charter or accessing our Service, you consent to these Terms. Should you disagree with our terms, you should refrain from using the Service.
2. Service Overview
GeneralAccessCrossing offers a variety of luxury yacht charter services, which include:
- Rental of yachts on a daily basis
- Cruises at dusk
- Retreats for businesses
- Exclusive gatherings
- Long-duration charters
Service availability is contingent on numerous factors and may change or be cancelled at any time without prior notice.
3. Booking and Reservations
3.1 Booking Process
When securing a charter, you are required to:
- Confirm that you are 18 years of age or older
- Submit true and complete details
- Provide the necessary deposit as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking will be established once payment is received and we send written confirmation. We hold the authority to deny service at our discretion.
3.3 Availability
We subject our charters to the availability of the vessel and suitable weather conditions. Our objective is to make every effort to accommodate your preferred schedule.
4. Payment Terms
4.1 Pricing
All charges are provided in € and incorporate all relevant taxes unless specified otherwise. Prices are subject to modifications without prior notice.
4.2 Payment Schedule
- Deposit: A charge of 50% of the total cost for the charter is required when booking
- Final Payment: Required 48 hours prior to the departure of the charter
- Any other charges: Due after the charter is completed
4.3 Payment Methods
We accept a variety of payment methods including major credit cards, wire transfers, and certified bank cheques. We ensure secure, encrypted handling of payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours prior to departure: A full refund less any processing charges
- Within 24 to 72 hours of departure: Refunded at 50%
- Less than 24 hours till departure: No refund will be provided
5.2 Weather Cancellations
Should the weather be determined unsafe by our captain, options include:
- Proposing a new date for the charter without any additional costs
- Issuing a complete refund if rescheduling proves unfeasible
5.3 Mechanical Issues
In cases of mechanical failure of the designated vessel, efforts will be made to supply a suitable substitute. If this is not possible, a full refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Comply with all instructions from the crew
- Utilize safety gear as needed
- Inform us of any medical conditions which could affect their safety
- Stay within designated areas on board
6.2 Prohibited Items
Items not allowed on board include:
- Containers made of glass
- Illegal substances
- Weapons of any form
- Excessively high quantities of non-alcoholic drinks (beyond a reasonable consumption limit)
- Pets, unless given prior approval
6.3 Conduct
Behavior among passengers should be considerate and respectful. We hold the right to end a charter prematurely, without recompense, if a guest's actions are deemed to compromise safety or disturb other patrons.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the amount paid for the charter. We bear no responsibility for:
- Injuries sustained due to the negligence of the passenger
- The loss or damage of personal belongings
- Indirect or penalizing damages
- Delays caused by weather or situations out of our control
7.2 Insurance Coverage
Our comprehensive insurance protects our fleet and operations. However, passengers should have their own travel and individual insurance.
7.3 Assumption of Risk
Engaging in our services signifies acknowledgment of the inherent risks involved with maritime activities and you assume all responsibility for your personal welfare and safety.
8. Modifications and Itinerary Changes
We maintain the authority to alter itineraries, courses, or schedules according to weather, safety measures, or operational demands. We will endeavor to provide suitable alternative experiences.
9. Force Majeure
Our responsibilities do not extend to issues caused by forces outside our control, this encompasses but is not limited to:
- Extreme meteorological conditions
- Catastrophes of nature
- Legal mandates
- Shutdowns of ports
- Failures of machinery
10. Privacy and Data Protection
Your personal data will be managed in line with our Privacy Policy. By using our services, you consent to the gathering and employment of your data as outlined in our Privacy Policy.
11. Intellectual Property
All material on our website, such as text, images, and logos, is under copyright and trademark protection. Unauthorized reproduction or distribution is not permitted barring our explicit consent.
12. Governing Law
The laws relevant in Monaco will govern these Terms, with all disagreements to be settled in the jurisdiction of courts within Monte Carlo, Monaco.
